Terms and Conditions — GSM Buy

1. Introduction

These Terms and Conditions (the “Terms”) govern access to and use of GSM Buy, including its website, marketplace and any related services (collectively, the “Platform”). By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. GSM Buy reserves the right to modify, amend, or update these Terms at any time in its sole discretion without prior notice. Continued use of the Platform constitutes acceptance of any such modifications.

2. Eligibility

The Platform is intended exclusively for individuals and businesses located within the United States. By using the Platform, you represent and warrant that you are at least eighteen (18) years old, have full legal capacity to enter into binding agreements, and possess the authority to enter into these Terms on your own behalf or on behalf of your business.

3. Platform Scope and Operations

GSM Buy provides an online ecosystem for the listing, sale, and purchase of mobile phones, accessories, and related services. While GSM Buy endeavors to ensure the accuracy, availability, and reliability of all content, products, and services, all items are provided “as is” and “as available.” GSM Buy does not warrant that any part of the Platform will be uninterrupted, error-free, or free of viruses or harmful components.

4. Third-Party Service Providers, Partners, and Affiliates

The Platform may incorporate or rely upon third-party providers, service partners, suppliers, affiliates, and other business entities (“Third Parties”) to facilitate its operations. These may include, but are not limited to, payment processors, shipping companies, logistics providers, content creators, and affiliate programs. You acknowledge that GSM Buy may receive compensation from affiliates or referrals and that the Platform may contain affiliate links, sponsored content, or other forms of promotional material. GSM Buy expressly disclaims any responsibility or liability arising from the actions, omissions, or performance of any Third Party.

5. Orders, Acceptance, and Limitations

All orders are subject to acceptance by GSM Buy in its sole discretion. GSM Buy reserves the right to refuse, cancel, or modify any order at any time for any reason, including but not limited to product availability, errors in pricing or description, suspicion of fraud, or violation of applicable laws or regulations. No contract or binding agreement shall be deemed created until GSM Buy confirms the acceptance of the order.

6. Pricing, Taxes, and Payment

All prices are listed in United States Dollars (USD) unless otherwise specified. You are responsible for all applicable taxes, duties, or other governmental fees unless otherwise noted. Payment processing may be facilitated by third-party processors, and GSM Buy assumes no liability for errors or delays caused by such processors.

7. Shipping and Delivery

Standard shipping is free unless otherwise specified. Estimated delivery times are provided for informational purposes only and are not guaranteed. GSM Buy is not responsible for shipping delays, lost packages, or damages incurred during transit, except for defective or damaged products reported within seven (7) days of delivery. Risk of loss and title transfer to the customer occur upon delivery by the designated carrier.

8. Returns, Refunds, and Defective Products

Returns and refunds are accepted solely for defective, damaged, or incorrectly shipped products. All claims must be reported within seven (7) days of delivery through the Platform’s “Start a Return” page. GSM Buy may require photographs, videos, or other documentation to substantiate claims. Approved defective or damaged items may be returned using a return shipping label provided by GSM Buy. Refunds will be processed to the original method of payment upon receipt and inspection of the returned item. All other returns, including change of mind, ordering the wrong item, or products no longer needed, are expressly excluded, and GSM Buy disclaims any liability for such requests.

9. User Conduct

You agree not to use the Platform for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the Platform or interfere with any other party’s use and enjoyment of the Platform. Prohibited activities include, but are not limited to, fraudulent activity, misrepresentation of identity, or transmission of harmful code or viruses.

10. Limitation of Liability

To the fullest extent permitted by law, GSM Buy, its officers, directors, employees, affiliates, agents, and licensors shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of revenue, profits, data, or business opportunities, arising from the use of or inability to use the Platform, reliance on third-party services, affiliate programs, or shipping delays, even if GSM Buy has been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless GSM Buy and its affiliates, officers, directors, employees, agents, licensors, and successors from any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising from your use of the Platform, violation of these Terms, infringement of any third-party rights, or any misrepresentation made by you.

12. Intellectual Property Rights

All content, trademarks, logos, graphics, images, software, and other materials on the Platform are the property of GSM Buy or its licensors and are protected under applicable intellectual property laws. No content may be copied, reproduced, distributed, transmitted, displayed, or otherwise used for commercial purposes without prior written permission from GSM Buy.

13. Affiliate and Promotional Programs

The Platform may participate in affiliate, referral, or promotional programs. Users acknowledge that GSM Buy may earn commissions or fees from these programs. GSM Buy is not responsible for the accuracy, reliability, or performance of affiliate products or services.

14. Privacy and Data Collection

Your use of the Platform is subject to GSM Buy’s Privacy Policy. By using the Platform, you consent to the collection, use, and storage of your data as described therein.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles. You expressly consent to the exclusive jurisdiction of the state and federal courts located within Wyoming for the resolution of any disputes arising from or related to these Terms or the use of the Platform.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, Return and Refund Policy, and any other documents referenced herein, constitute the entire agreement between you and GSM Buy regarding the use of the Platform and supersede all prior agreements, understandings, or representations, whether written or oral.

18. Additional Provisions

GSM Buy may, in its sole discretion, introduce new features, services, or programs in conjunction with third-party partners or affiliates. Participation in any such programs is governed by these Terms and any additional rules communicated at the time. GSM Buy disclaims any liability arising from participation in third-party programs or services.
